MANILA, Philippines — The Commission on Elections Second Division has declared Benny Abante as the duly elected Representative of the Manila City 6th District in the 2025 midterm elections.

This came after the division voided the certificate of candidacy of Joel Uy, whose proclamation is considered “annùlléd.”

Lol, ang Supreme Court at si Prof. Dante Gatmaytan sa Inquirer! Sabi sa Mangudadatu ruling, inabandona ang second-placer rule para sa local elections—governors, mayors—kasi may succession sa RA 7160. Pero sa Congress, tulad kay Abante sa 6th District, walang ganyan.

Si COMELEC Chair Garcia nag-a-appeal ng Mangudadatu para sa local cases, hindi kay Uy o Abante. Kailangan nila linaw kung paano ia-apply sa local elections, not Congress mismo.

Tama ka dyan. Comelec 2nd Division lang ang nag-void kay Uy’s COC, at ina-appeal niya sa En Banc. Kung matalo, pwede pa sa Supreme Court. Pero kahit may appeal, si Abante pa rin ang proclaimed winner unless baliktarin ng En Banc or SC.

Basahin mo mabuti ‘yung Mangudadatu ruling, page 34! Sabi ng Supreme Court, “the Court hereby abandons the second placer rule and declares that the rules on succession under the LGC shall apply in all cases where a permanent vacancy results from a local elective official’s disqualification.” Local elections lang ‘to,—governors, mayors—kasi may succession under RA 7160, like vice-governor taking over (page 22, page 35).

Gets ko na, wala ka naman na mention na COMELEC yung tinutukoy mo. Si Garcia mismo nagsabi na nagkataon lang na malapit ang June 18 ruling nila kay Uy at ang June 19 release ng Mangudadatu, hindi nila alam ‘yung SC ruling noon. Ang COMELEC appeal na in-announce nung June 23 ay para sa Mangudadatu, at nasa 15-day deadline ‘yan para mag-file ng motion to reconsideration.

It is a norm for the Supreme Court of the Philippines to delay the public release of rulings after their promulgation. The Supreme Court’s process involves several stages: deliberation, promulgation (when the decision is finalized and signed by justices), and public release via the SC PIO or the Supreme Court E-Library.

Normal lang na hindi kaagad kumilos ang COMELEC after April 22 kasi ang Supreme Court ruling, kahit promulgated na, inilabas lang publicly nung June 19, 2025, nang ma-receive ng SC Public Information Office. Karaniwan ‘yan sa Supreme Court—may delay sa pag-publicize kasi kailangan i-finalize ang decision, kunin ang signatures ng justices, at ihanda ang dissemination.
