Fanatic

Any insight to this?

Thankss sana may makahelp

Hi! Based on what you shared, since there is no specific provision in your contract regarding extending your resignation period beyond the initial 30 days, you are not obligated to do so. Your TL's request for you to extend your resignation period is voluntary on your part.

If your TL mentioned that there is someone lined up to replace you but that person is still in training and not yet considered fully productive, it is understandable that they are seeking an extension from you. However, the decision to extend your resignation period is ultimately up to you.

You have fulfilled your obligation by rendering the initial 30 days as per your contract, and you have the right to stick to your original resignation timeline. If you feel that extending your resignation period would not be in your best interest, you can politely decline your TL's request.

It would be beneficial to communicate openly and professionally with your TL about your decision and to explain your reasons for not extending your resignation. Remember to do so respectfully to maintain a positive relationship with your current employer.

According to the Labor Code of the Philippines, specifically Articles 285 and 286, employees are required to provide a 30-day notice unless the resignation is due to just causes, such as serious insult by the employer, inhumane treatment, or other valid reasons.
The employer cannot compel an employee to stay beyond the notice period unless there are specific contractual obligations or agreements in place.

You've done your part already wala ka ng accountability sa kanila. The employer's request for an extension is typically a negotiation rather than a legal obligation unless otherwise specified in your contract na feel ko naman wala kayong pinag-usapan na ganon so hindi mo na problema yan. Decline the extension.

If there are any disputes or if you feel pressured by your employer, you can consult with DOLE for guidance and support. They can provide legal assistance and ensure that your rights as an employee are protected.
