Tapo Silog flew to Korea to work in the entertainment industry. He has a property in Baler, Aurora, and called via cellphone his cousin, Lango Silog, in the Philippines to sell the land in his behalf. On April 8, 2023, Lango was able to sell the land to a rich tourist, Omel Leto. Unaware of the sale, Tapo also sold the land to Kimmy Chi, his Korean friend, on April 18, 2023, who was a looking for a place to retire to in the Philippines.



Who between Omel Leto and Kimmy Chi has a better right to the property? Explain.

In this case, Omel Leto has a better right to the property as he acquired it first. The general rule in property law is that the first person to register a property or acquire it in good faith and for valuable consideration has a better right over the property.

In this case, Lango Silog was able to sell the land to Omel Leto on April 8, 2023. Although Tapo Silog owns the property, he authorized his cousin to sell it on his behalf. Therefore, Lango Silog had the authority to sell the land to Omel Leto. Omel Leto acquired the property in good faith and for valuable consideration, which means he did not know about any competing claims and ρáíd a fair price for the property.

On the other hand, Tapo Silog sold the same property to his Korean friend, Kimmy Chi, on April 18, 2023, which was after the sale to Omel Leto. Therefore, Kimmy Chi did not acquire the property in good faith as she knew or should have known that the property was already sold to someone else. Moreover, Kimmy Chi did not register the property or acquire it for valuable consideration.

Based on these circumstances, Omel Leto has a better right to the property as he acquired it first in good faith and for valuable consideration. Therefore, Tapo Silog should return the payment received from Kimmy Chi and provide her with compensation for the inconvenience caused.
