So kung sa property ng kapitbahay mo talaga nakatanim ang puno kahit lumalagpas ang mga sanga sa’yo sila ang may-ari at therefore may primary responsibility sa punong iyon.
You have the right to demand the trimming or cutting of branches and roots that encroach upon your property, especially if it causes
- Obstruction
- Damage
- Excessive inconvenience (like constant falling leaves or danger from falling branches)
If the neighbor refuses to act, and the tree poses danger or causes nuisance, you may file a complaint with your Barangay (Lupong Tagapamayapa) for amicable settlement
