💡 Trivia Let Duterte run again as president -- Alvarez

A provision in the 1987 Constitution limits presidents to one fixed six-year term without reelection. The provision is an offshoot of the dictatorship of the late president Ferdinand Marcos Sr., who perpetuated himself in power for 20 years until his ouster in 1986. “The President shall not be eligible for any reelection,” the Constitution states. But Alvarez believes the prohibition refers only to consecutive presidential terms. “It refers to the sitting or incumbent president not allowed for reelection,” he stated.

Comments show na Duterte power is gone. Gusto mag peoples power wala namang enough people. Pano pa magkakapower? Power grabbing lang gusto nyo.

genuine question lang po, if former president take the accountability sa lahat ng ngyare sa war on drugs ano pang inaantay ng congress para mag take ng action para ipakulong siya? tsaka bat parang highschool debate yung nasa quadcom nakakahiya.

walang manhid boss, both are claiming sila ang tama, it's a clash of ideologies

lol both parties can also claim na mali yung sa kabila, as i've said ideologies yan, walang tama o mali

even criminals have an ideology na pinag lalaban bossing, di yan solo for good people only

Ehhh?
Section 4. The President and the Vice-President shall be elected by direct vote of the people for a term of six years which shall begin at noon on the thirtieth day of June next following the day of the election and shall end at noon of the same date, six years thereafter. The President shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time.

Harapin na lang niya yung complaints and give his best to overcome them if he can. Parehas lang yung resulta niyan tulad ni Juan Ponce Enrile he he. Walang proper quorum, professionalism, etc. coming from highly respectable individuals. Alam nyo na kaagad kung bakit!

Ang politika naman dito ay weather-weather lang. Malas mo kung mapag-initan ka after your term is finished. "Get used to it" eka nga, dahil naging practice na yan dito noon pa man.

He he.
Tapos itong "No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time" reinforces the idea that a former President who has served a full term cannot seek re-election. Meaning, the Constitution does not provide exceptions for non-consecutive presidential terms or the prohibition on presidential re-election under the current constitution still applies.
Kung ikukumpara naman yung case sa dating presidente na si Joseph Estrada na tumakbo ulit noong 2010, nakalusot lang siya due to technicalities, and he only served as president for 2yrs and 5 months kaya eligible siya.
Kung bukas ang isip ng tao at alam ang batas, yung sinasabi ni Alvarez is just a political scheme for the "Dutertes" who are in the hot seat! Stay tuned na lang tayo sa mangyayari he he.

alvarez just took advantage of the silence ni constitution on whether consecutive and non-consecutive terms can be differentiated when enforcing the rule

"Thinking out of the box", I agree. Pero hanggang doon lang tayo, since panahon pa ni Fidel Ramos at hanggang kay DU30 ay alam natin na fixed na yung stance regarding this case hanggang sa Supreme Court - a president is not eligible for re-election. Sa ibang position pwede, as long as they follow similar rules regarding re-election on government positions. Ang pwede lang makapagbago dyan is through provisions/reforms via Constituent Assembly (via Senate and Congress), Constitutional Convention (or a similar variant like Charter Change) at Plebiscite (or People's Initiative). Yan lang isa sa tatlo ang paraan to change any amendment (or the entirety) in our Constitution, like a former president seeking for re-election - incumbent or not. Ito yung target ni Alvarez from his statements as I see it. Yan yung proseso to possibly make it happen. There is no way to circumvent it as of this time just by mere statements alone.

hehe power of suggestion yan kasi, just keep pointing out the loopholes until fix arrives, ilalaban pa yan sa korte and if proven na meron loophole then an action must be done, gaya din nung substitution technique which matagal ding na-exploit bago inaksyonan

He he. Thanks for reminding. Our judicial system has also the power for that too (for checks and balance) if this plea is heard officially. But since that law was amended noong 1987 Constitution pa with the intention of restricting Martial Law powers and limiting terms of elected officials as well as fixing its meaning, dim yung chance just because of a grammar controversy loophole. Kaya nga lumabas yung mga attempts/plans to amend the constitution to include lifting of term limits of public officials from the era of FVR (carter change) - DU30 (federalism), because they can't overrule the term limits. Parang cat and mouse game yung nangyayari.

May the best man/woman win na lang sa kanila he he.

the fact na banned na ang re-election for consecutive terms is already the "bisa" bossing
i also don't see any connection ng federalism sa pagtanggal ng limit

Just for discussion, binanggit ko yang federalism kung sakali lang may mag-push ulit, dahil yung last account ko sa supposedly draft constitution ni DU30 last 2018? (not sure of the date and authenticity of the claims). It mentioned provisions abolishing the 6-yr term to "4 years and one re-election" or "2 consecutive 4-year terms" from other sources. But the essence is there related to the limits. If I'm wrong, I stand corrected. Alam mo naman sa net, hindi lahat, eksaktong totoo yung nababasa natin he he.
Ito yung 2018 draft pdf which includes what I mentioned ng mag-google search ako ng actual document (to verify) before I made this post:
