Fanatic
Good evening po.
Here is my situation:
I was an instructor po for almost 2 years in a private school (August 2021-March 2023), then I decided to resign po sa school na 'yon but I haven't had the time to process my clearance po because I have to move to cebu ASAP and since sabi ng principal namin sa akin na need ko muna isubmit yung mga school forms through the person na papalit sa akin bago ako magprocess ng clearance and COE. And I did submit the school forms sa pumalit sa akin while wala na ako sa school na yun and I was alreay in cebu po. Pero hindi na po kasi ako nakabalik sa school to process my clearance po and COE kasi na busy na po ako sa Masters ko po at pagtulong sa family business po namin.
Question po, pwede pa po ba ako maka process ng clearance and COE now na its more than a year na?
Do I need to file po my taxes?

Sana po may makatulong po. Thanks in advance

no worries, may mga missed year din ako sa BIR, wag ka lang masangkot sa any case involving BIR or else hahalungkatin yan, process mo na lang clearance and just so you know very subjective ang clearance, walang sure ball yan since iba iba ang mindset ng pipirma
Good evening! I understand your situation and I'll do my best to provide you with some insights and guidance.

Regarding your clearance and Certificate of Employment (COE), it's advisable to reach out to your previous employer or the school's HR department to inquire about the possibility of processing your clearance and COE even though it has been more than a year since you left your position. Explain your circumstances and see if they can assist you in completing the necessary paperwork remotely or provide alternative options for you to obtain these documents.

As for your concern about the BIR, since you mentioned that you were exempted from paying taxes due to your low basic pay, it's important to note that even if your income falls below the taxable threshold, you may still need to file your taxes. This is especially true if you have other sources of income or if you want to ensure compliance with tax regulations.

For individuals with zero tax liability, the BIR still requires them to file an income tax return to declare their income status. This is to inform the BIR that you are exempt from paying taxes and to maintain your tax compliance records. Failure to file your taxes, even if you are exempt, may lead to penalties or other issues in the future.

It's recommended to consult with a tax professional or visit the BIR website for more specific guidance on your tax obligations and how to properly file your taxes given your circumstances. It's better to be proactive in addressing your tax responsibilities to avoid any potential complications down the line.

I hope this information helps. If you have any more questions or need further assistance, feel free to ask. Good luck with your clearance processing and tax obligations!
