DICT issues amendments on guidelines for new major telco player

After two stakeholders’ consultations and various meetings with the International Telecommunication Union (ITU) during the first quarter of 2018, the Department of Information and Communications Technology (DICT) issues the Memorandum Order (MO) 002, amending certain provisions of the DICT Memorandum Order 001 on the “Policy Guidelines for the Entry of a New Major Player in the Telecommunication Market.” This was signed on 13 April 2018 by the DICT Officer-in-Charge Eliseo M. Rio, Jr.
Under the current Memorandum Order, an interested party must have ρáíd in capital of at least Php 10B as indicated in its latest financial statements to prove financial capability; must have experience in provisioning, delivery, and operations of telecommunication services for the last five years; and should be a holder of a congressional franchise that is not related to any dominant telecommunication player and has no any outstanding liabilities with the National Telecommunications Commission (NTC) as of 31 January 2018.
In addition, the highest committed level of service (HCLoS formula) will be considered as one of the methods in selecting the NMTP. This is aside from the earlier method in choosing the NMTP base on the highest committed level of investment in the first five years.
Amendments also entail the involvement of an Oversight Committee, which was directed to assist NTC in the formulation of the Memorandum Circular (MC) that shall contain the Terms of Reference (TOR) in selecting the NMTP. This is pursuant to the Administrative Order No. 11 signed by President Rodrigo Duterte last 06 April 2018.

MANILA - The selection of the country's third major telecommunications company may have to wait until July, the Department of Information and Communications Technology (DICT) said Tuesday.
DICT officer-in-charge Eliseo Rio said the deadline for the submission of bids for the third telco, which had already been moved to May 24, may have to be moved again.

On the DICT Facebook page, Rio said that the announcement of the third telco may have to wait until the "end of June or early July."
Rio, however, assured that the announcement will be done before the State of the Nation Address of President Rodrigo Duterte on July 23.
He said that the DICT is still finalizing the terms of reference (TOR) for the selection of the new telco player.
"We are still finalizing the draft TOR, so that when published for comments, suggestions and position papers from stakeholders, it will be more complete and comprehensive than the first draft," Rio said in a message on Facebook.
"The final TOR must be attractive enough to contenders for the Third Telco Player but at the same time not anti-competitive to the incumbent telcos," he said.
The publication of the TOR was originally set for last week ahead of a public consultation, but the DICT now expects to publish it after the Holy Week holidays or around the first week of April.
President Rodrigo Duterte had wanted the next major telco, which will compete with Globe and PLDT, to be named by March. The expectation is greater competition would lead to better services for the public.
