Dear PHC-DeepMods,
We, the SongHub Developers under the brand of the SongHub android software application and the SONGHUB mark. We write to demand that you immediately stop modifying and distributing altered versions of SongHub.
1. Your Conduct
We have learned that PHC-DeepMods has distributed modified versions of SongHub at [Phcorner / Songhub Mod Apk / October 5, 2026]. Specifically, you have:
• Decompiled or reverse engineered SongHub and distributed altered builds [describe: patched APKs, modified executables, etc.];
• [If applicable: circumvented SongHub's license verification, encryption, or other protection measure to enable unauthorized use or access to ρáíd features;]
• [If applicable: removed or altered the Company's copyright notices and attribution in the modified builds;]
• Used the SongHub name and branding in connection with these builds [describe], which is likely to cause confusion about their source or to suggest affiliation with or approval by the Company; and
• Encouraged and enabled third parties to download, install, and use these builds in violation of the Company's license terms.
2. Legal Basis
Your conduct gives rise to, among others, the following claims.
A. Copyright infringement. Copying, modifying, and distributing SongHub, and creating unauthorized derivative works from it, infringes the Company's exclusive rights under 17 U.S.C. §§ 106 and 501 [and, under Philippine law, Sections 177 and 216 of the Intellectual Property Code, Republic Act No. 8293].
B. Contributory and inducement liability. By distributing the modified builds and encouraging others to use them, you knowingly induce, cause, and materially contribute to infringement by your users.
C. Circumvention and removal of copyright management information. [If applicable:] Bypassing SongHub's technological protection measures violates 17 U.S.C. § 1201, and removing or altering copyright notices violates 17 U.S.C. § 1202.
D. Trademark infringement and false designation of origin. Using SONGHUB or a confusingly similar name in connection with unauthorized builds violates 15 U.S.C. §§ 1114 and 1125(a) [and, under Philippine law, Sections 155 and 168 of Republic Act No. 8293].
E. Unfair competition and misappropriation. Trading on the Company's goodwill and distributing altered versions of its product constitutes unfair competition under federal and state law [and Section 168 of Republic Act No. 8293].
F. Breach of contract and tortious interference. Reverse engineering and modification breach the license terms. Inducing other users to breach those terms constitutes tortious interference with the Company's contracts.
G. Unauthorized access. [If applicable, e.g., if the mods bypass server-side checks or access the Company's systems without authorization:] This conduct violates 18 U.S.C. § 1030 [and Section 4(a) of the Cybercrime Prevention Act, Republic Act No. 10175].
3. Remedies
If this matter proceeds, the Company will seek all available relief, including injunctive relief; impoundment and destruction of infringing materials; actual damages and your profits; [statutory damages and attorneys' fees, where the Company's registrations allow;] and costs. [Under Philippine law, the Company will seek the remedies provided by Section 216 of Republic Act No. 8293.]
4. Demands
By [October 13, 2026] (seven days from the date of this letter), you must:
1. Stop all modification, reproduction, and distribution of SongHub and any derivative works;
2. Remove all modified builds, download links, repositories, and posts from every site and channel you control, and delete all copies in your possession;
3. Stop using "SongHub" or any confusingly similar name, logo, or branding, and remove any statement implying affiliation with the Company;
4. Provide written confirmation of compliance, including a list of every location where the builds were distributed [and approximate download counts];
5. Pay the Company 20,000 [currency: PHP / USD] as compensation for your unauthorized modification and distribution of SongHub in violation of its license terms, by Gcash to Songhub admin, 09355411750; and
6. Preserve all documents, code, communications, and distribution records relating to this matter.
If you comply with all of the above by the deadline, the Company is prepared to treat the matter as resolved as to the past conduct described in this letter. This is conditioned on your full compliance and does not waive any claim based on other or future conduct.
5. Other Potential Liability
Some of the conduct described above may also constitute an offense under 17 U.S.C. §§ 506 and 1204 [and Section 217 of Republic Act No. 8293 / Republic Act No. 10175]. The Company reserves all rights in this regard.
6. Reservation of Rights
This letter does not state all of the facts or all of the Company's rights and claims, none of which are waived. If we do not receive satisfactory confirmation by the deadline above, the Company may pursue all available remedies without further notice.
