Ex-Justice Carpio Statement On Ngagba Calling For Special Senate Session.

“The president can call for a special session, only to enact a law that is necessary to be enacted and this trial [impeachment] is not a law,” Carpio said in a television interview.

With the Senate only set to resume from June 2 to 13, Carpio stressed there is "no more time" to hold the trial. He blamed the House of Representatives for delaying the transmittal of impeachment articles, preventing the Senate from tackling the case before adjourning.

Carpio also noted that even if the trial pushes through, the Senate must first revise and publish impeachment rules, and Duterte would have 10 days to respond—further delaying proceedings.

Meanwhile, election lawyer Romulo Macalintal argued that the current Senate must resolve the case before adjourning, as the next Senate may opt not to continue it. He cited a 2008 Supreme Court ruling stating unfinished legislative matters do not automatically carry over.
