1. Lease rates for fishpond areas shall be determined by the Department: Provided, That all fees collected shall be remitted to the National Fisheries Research and Development Institute and other qualified research institutions to be used for aquaculture research development

4. The transfer or assignment of rights to FLA shall be allowed only upon prior written approval of the Department;

5. The lessee shall undertake reforestation for river banks, bays, streams, and seashore fronting the dike of his fishpond subject to the rules and regulations to be promulgated thereon; and

6. The lessee shall provide facilities that will minimize environmental pollution, i.e., settling ponds, reservoirs, etc: Provided, That failure to comply with this provision shall mean cancellation of FLA.

1. Lease rates - Ang halaga ng pag-upa ng mga fishpond area na itatakda ng Kagawaran: Binibigyan ng kahulugan na lahat ng bayarin na kolektado ay ipapadala sa National Fisheries Research and Development Institute at iba pang mga kwalipikadong institusyon sa pananaliksik upang magamit sa pagpapaunlad ng pananaliksik sa aquaculture.

Halimbawa:

• Ang lease rates para sa fishpond areas ay itinakda ng Kagawaran ng Pangingisda.

2. Producing on a commercial scale - Ang lugar na inuupahan ay dapat maipatayo at mag-produce sa komersyal na antas sa loob ng tatlong (3) taon mula sa pag-apruba ng kontrata sa pag-upa: Gayunpaman, Ang lahat ng mga lugar na hindi ganap na nagpo-produce sa loob ng limang (5) taon mula sa petsa ng pag-apruba ng kontrata sa pag-upa ay awtomatikong babalik sa pampublikong lugar para sa reforestation.

Halimbawa:

• Dapat mag-produce sa komersyal na antas ang inuupahang lugar sa loob ng tatlong taon.
• Ang mga lugar na hindi nagpo-produce nang sapat ay babalik sa pampublikong lugar para sa reforestation.

3. Subleased - Ang fishpond ay hindi pwedeng ipaupa muli, buo man o bahagi lamang, at ang paglabag sa probisyong ito ay nangangahulugan ng kanselasyon ng FLA.

Halimbawa:

• Bawal ipaupa muli ang fishpond, buo man o bahagi lamang nito.
• Ang hindi pagsunod sa probisyong ito ay magreresulta sa kanselasyon ng FLA.

4. Transfer or assignment - Ang paglilipat o pag-aasign ng karapatan sa FLA ay papayagan lamang sa pamamagitan ng pahintulot na nakasulat mula sa Kagawaran.

Halimbawa:

• Dapat magkaroon ng pahintulot na nakasulat mula sa Kagawaran bago maganap ang paglilipat o pag-aasign ng karapatan sa FLA.
• Ang paglilipat o pag-aasign ng karapatan sa FLA ay kailangan ng pahintulot mula sa Kagawaran.

5. Reforestation - Ang lessee ay dapat magpatupad ng reforestation para sa mga river banks, bays, streams, at seashore fronting sa dike ng kanyang fishpond alinsunod sa mga alituntunin at regulasyon na ilalabas doon.

Halimbawa:

• Ang lessee ay responsable sa reforestation ng river banks at iba pang lugar malapit sa kanyang fishpond.
• Dapat sundin ng lessee ang mga alituntunin at regulasyon sa reforestation ng kanyang fishpond.

6. Environmental pollution - Ang lessee ay dapat magbigay ng mga pasilidad na magmiminimisa sa environmental pollution, tulad ng settling ponds, reservoirs, at iba pa: Gayunpaman, Ang hindi pagsunod sa probisyong ito ay nangangahulugan ng kanselasyon ng FLA.

Halimbawa:

• Dapat maglaan ng mga pasilidad ang lessee na magmiminimisa sa environmental pollution.
• Ang hindi pagsunod sa probisyong ito ay magreresulta sa kanselasyon ng FLA.
