Hello mga ka-PHC. Kakapost ko lang ulit and problema agad haha. Anyways, kidding aside, I just need your help/advice.

May question po is, is it justifiable na i-hold ng supervisor mo ang last pay mo? Knowing that you have already rendered enough service effort, time, and money within the last Month of your employment. Additionally po, may pinapagawa kase siya na beyond my employment time-frame and almost impossible (For example: Officially resign ka na this June pero may pinapatapos pa sayo na documents pero this July ang submission). Kapag di mo natapos ang pinapagawa, di nya daw pipirmahan ang iyong last pay documents.

I really need your advice ka-PHC on what should I do with this kind of matter.

What are your thoughts?

Hello! I understand your concern and it's definitely important to address this issue regarding your last pay being withheld by your supervisor. In general, it is not justifiable for a supervisor to hold an employee's last pay, especially if the work has been completed and the employee has fulfilled their duties up to the last day of employment.

Regarding the situation where your supervisor is asking you to complete tasks beyond your official resignation date, it can be a tricky situation. If these tasks are clearly beyond your employment timeframe and are not part of your usual responsibilities, you may have grounds to refuse completing them without additional compensation. It's important to refer to your employment contract or company policies to understand your rights and obligations in such situations.

If your supervisor is withholding your last pay as leverage for completing these tasks, it could be seen as unfair and possibly îllégâl. In many jurisdictions, there are labor laws that protect employees' rights to receive their full pay in a timely manner upon resignation or termination.

My advice would be to first try to communicate with your supervisor and E×ρréšš your concerns in a professional manner. You can clarify your understanding of your responsibilities and seek clarification on why your last pay is being withheld. If the issue persists, you may consider seeking guidance from your company's HR department or even consult with a legal professional to understand your rights and options in this situation.

Remember, it's important to advocate for yourself and ensure that you are being treated fairly and in accordance with labor laws. Good luck, and I hope you are able to resolve this matter satisfactorily.

Hindi. If yes. You can freely leave the company at hindi naman mahohold yung last pay mo kase HR yung may hawak diyan.

Actually, you can leave naman yung company without resignation. But that's unprofessional and of course you wouldn't get a COE.

Grabe yang supervisor mo, buti aalisan mo na yan🤣

Have you tried to raise that concern of yours to your HR dept?

1 and 1/2 year sana yung contract and maganda po yung project.

if those documents are your backlogs then tama yan na hold last pay mo, if ayaw mo magpa hold then magpa terminate ka na lang with a cause para mabilis

I think reasonable po if ganito, pero as far as I know wala naman akong backlogs based sa workplan. And as I said po, yung documents na hinihingi nya is to be accomplish sa July based sa workplan and parang binibigay sakin yung some of the workload for July.

just accomplish the company clearance boss, even if di siya pumirma nag approve pa din naman siya sa effectivity date, so resigned ka pa din, contest mo na lang sa DOLE ang last pay
